2020-001 -116-AI New Source Review (NSR) Repeal of Obsolete Rules and Project Emissions Accounting (PEA)
Post-QRR review, this rulemaking would repeal outdated sections, and additional rules as necessary, to remove or update cross-references to the rules which are being repealed. Additionally, this rulemaking would amend rules relating to nonattainment new source review and prevention of significant deterioration permitting consistent with EPA guidance issued on March 13, 2018 and EPA's subsequent 2019 proposed rulemaking on August 9, 2019.

The Air Permits Division is initiating the development and issuance of a non-rule standard permit for marine vessel loading and unloading facilities under Texas Administrative Code (30 TAC) Chapter 116, Subchapter F. The proposed non-rule standard permit would authorize construction and operation of facilities associated with marine vessel loading and unloading, including support facilities and maintenance, startup, and shutdown (MSS) emissions.

The proposed rulemaking would implement SB 2, Section 44, 86th Texas Legislature, by revising the title of 30 TAC Chapter 18. Additionally, the rulemaking would amend 30 TAC Chapter 17 to address advice and recommendations after reviewing Tier I Table and Expedited Review List; add pollution control property recommended by the committee to the Tier I Table and include any changes needed that are associated with addressing HRSGs or additional Tier I Table additions; and modify the Tier I Table to ensure consistency.

The petitioner requested that the commission initiate rulemaking to amend 30 TAC Chapters 30 and Chapter 285 to better protect public health and the environment by amending existing rules to create more consistency with industry terminology and standards. This includes adding language to more easily identify Responsible Parties, by including definitions of TCEQ licensed individuals, the creation of a new licensing/registration program for sludge pumpers by the commission, and general language updates for consistency.

This rulemaking implements HB 2386, 85th Texas Legislature, 2017, by incorporating necessary revisions to 30 TAC Chapter 111. Specifically, 30 TAC §111.209 is amended to allow volunteer firefighters to provide supervision of outdoor burning in counties with a population of less than 50,000 in areas outside of a municipality.
